A legal document in which the “Principal” appoints an “Agent” with the authority to act on his or her behalf in financial, legal and government matters. Examples of “powers” under a POA include but are not limited to making financial decisions, handling investments and real estate, filing tax returns, filing and defending lawsuits and managing the Principal’s business.

The Agent’s authority under a POA may begin immediately OR upon the Principal being deemed incapacitated.
A POA plans for incapacity if it is “Durable,” because it allows the Agent to act on behalf of the Principal even if the Principal becomes incapacitated. Someone is incapacitated when a physician finds that the Principal is unable to manage his or her financial affairs.
Without a POA, if you become incapacitated your loved ones would be forced to petition the California Probate Court for conservatorship over you in order to legally act on your behalf.
